These terms regulate, on the one hand, the conditions of use, access and registration on the website www.abonoteatro.com (hereinafter, the “Terms of Use” and the “Website”, respectively), by any person (hereinafter, any user duly registered on the Website in accordance with the provisions set out in this document shall be referred to as the “Subscriber” or the “Subscribers”), as well as the purchase terms for the Subscription offered on the Website (hereinafter, the “Purchase Terms”). The Terms of Use and the Purchase Terms may be jointly referred to as the “Terms”.

FIRST SECTION. TERMS OF USE

By accepting these Terms of Use, the Subscriber expressly agrees to be bound by them in their entirety and scope, without excluding any of their provisions. ABONOTEATRO reserves the unilateral right to modify, at any time and at its sole discretion, the terms of the Terms of Use included in this document. When this occurs, a notice will be included on the Website indicating and informing Subscribers that modifications have been made; and the Subscriber will be duly informed. Likewise, ABONOTEATRO reserves the right to alter, modify or suspend any feature of the Website. Access to and use of the Website after the entry into force of any modifications or changes to these Terms of Use implies full and unreserved acceptance thereof.

I. ACCESS TO AND TERMS OF USE OF THE WEBSITE

Mere access to the Website is free of charge for both Subscribers and non-Subscribers, who, however, may not view the full content and programme, available on the Website exclusively to Subscribers. Accordingly, once logged into their private account, the Subscriber may freely and free of charge browse and view all content, as well as the products offered on the Website.

Any person interested in becoming a Subscriber must purchase the subscription by paying the corresponding price, subject to the provisions of the Purchase Terms, and must then register on the Website, free of charge, through the registration form. Once the Subscriber has registered on the Website, they shall be authorised to access the full content of the Website, in accordance with Clause III of these Terms of Use.

By browsing, using or viewing the content of the Website, the Subscriber declares that they are over eighteen (18) years of age or, failing that, that they have the due authorisation of their legal guardians.

1.1. Rules for use of the Website

The Subscriber must: (i) obtain all means and technical requirements needed to access the Website and use the services available through it; and (ii) provide truthful information when completing the forms contained on the Website with their personal data and keep such information updated at all times so that it reflects, at all times, the Subscriber's actual situation. The Subscriber shall be solely responsible for any false or inaccurate statements made and for any damage caused to ABONOTEATRO as a result of the information provided.

Accessing or using the Website for illegal or unauthorised purposes, with or without profit motive, is not permitted and, therefore, the consequences thereof shall be the exclusive responsibility of the Subscriber. In particular, and without limitation, the following is prohibited:

Using the Website in any way that may cause damage, interruptions, inefficiencies, overloads, deterioration or defects in its operation or in the computer equipment of a third party;
Causing damage to the physical or logical systems of the Website, its providers and/or third parties;
Using the Website to transmit, install or publish any virus, malicious code or other harmful programmes or files;
Using the Website to collect personal data from other Subscribers;
Using the Website fraudulently or unlawfully, contrary to good faith, morals and public order and/or in a manner harmful to the rights and interests of third parties;
Registering through the Website under a false identity, impersonating third parties or using a profile or carrying out any other action that may confuse other Subscribers as to the Subscriber's identity;
Accessing without authorisation any section of the Website, other systems or networks connected to it, ABONOTEATRO's servers or the services offered through the Website by means of hacking or forgery, password mining or any other illegitimate means;
Breaching, or attempting to breach, the security or authentication measures of the Website or of any network connected to it, or the security or protection measures inherent in the content offered on the Website;
Carrying out any action that causes a disproportionate or unnecessary saturation of the Website infrastructure, ABONOTEATRO's systems or networks, or the systems and networks connected to the Website;
Preventing the normal development of any service, event, promotion or any other activity available through the Website or any of its functionalities, whether by illegally or otherwise altering or attempting to alter access to or the operation of the foregoing, or by falsifying the result thereof and/or using fraudulent participation methods, through any procedure and/or any practice that infringes or violates these Terms of Use;
Obtaining or attempting to obtain the content available on the Website using means or procedures other than those (i) made available by ABONOTEATRO to Subscribers for this purpose, or (ii) expressly indicated on the websites where the content is located, or, in general, those (iii) customarily used on the Internet so as not to entail a risk of damage, inappropriate use or disabling of the Website and/or the content.

1.2. Duration

Subscriber status shall be granted to any person who browses the Website and effectively purchases the Subscription offered on the Website, which shall allow them to view the full content of the Website; and such status shall remain in force indefinitely while their subscription purchased in accordance with Clause 2.2 below remains valid, or until ABONOTEATRO is no longer able to provide the services or access to the Website.

II. REGISTRATION AS A SUBSCRIBER OF THE WEBSITE

2.1. Registration as a Subscriber of the Website

Subscribers who have purchased the subscription, subject to the provisions of the Purchase Terms, and subsequently registered as Subscribers through the registration form free of charge, shall have access to the full programme of the Website and may use the private area enabled on the Website.

In order to register as a Subscriber, it is necessary to have provided all required data classified as mandatory, as well as to have previously purchased the Subscription offered by ABONOTEATRO through the Website, subject to the Purchase Terms set out later in these Terms.

Once the subscription has been purchased and, consequently, the corresponding Subscriber number has been assigned, the Subscriber must register on the Website to enjoy the advantages and benefits of their subscription. For this purpose, once they have correctly provided the necessary data classified as mandatory, by pressing the “Register” button on the form, the Subscriber may create and access the private area of their subscription. Once inside the private area, the Subscriber may access the full information on theatre, cinema and other event programming in order to contract the services offered by ABONOTEATRO through the Website.

Once the Subscription offered by ABONOTEATRO has been purchased, a unique Subscriber number shall be assigned for identification purposes, which must be entered during the registration phase in the section corresponding to the Subscriber number. In this regard, the Subscriber shall have their DIGITAL SUBSCRIBER CARD available, with their name and membership number, in the private area of the Website, namely in the MY ACCOUNT – MY ABONOTEATRO section.

Once the registration form has been completed subject to the conditions established for this purpose and indicated in these Terms, the Subscriber will receive an email to validate the email address associated with the purchased subscription, thereby completing the registration process on the Website.

Each Subscriber must be registered with an email address that cannot be valid for another subscriber. Accordingly, two Subscribers may not share the same email address.

Likewise, the Subscriber acknowledges that the password and Subscriber account are personal and non-transferable.

The Subscriber may change their password at any time using the tools made available by ABONOTEATRO.

The Subscriber undertakes to make diligent use of their password and keep it secret, and may not disclose it to any third party. Consequently, Subscribers shall be responsible for the proper custody and confidentiality of any identifiers and/or passwords they have selected as registered Subscribers, and undertake not to assign their use to third parties, whether temporarily or permanently, nor to allow third parties to access their account. The Subscriber shall be responsible for the lawful use of their account and shall be liable for any damage generated by a third party accessing it using their access credentials.

By virtue of the foregoing, the Subscriber is obliged to immediately notify ABONOTEATRO of any fact that allows the improper use of identifiers and/or passwords, such as theft, loss or unauthorised access thereto, in order to proceed with their immediate cancellation. Until such facts are reported, ABONOTEATRO shall be exempt from any liability that may arise from the improper use of identifiers or passwords by unauthorised third parties.

In any case, ABONOTEATRO reserves the right of admission of any potential Subscriber.

2.2. Duration

Access as a Subscriber shall begin once the corresponding registration procedure has been successfully completed (that is, once the data required to carry out registration have been entered, and once the Subscriber has validated their email, which includes the required purchase of the subscription offered by ABONOTEATRO), and after acceptance of the Privacy Policy and these Terms of Use.

In accordance with Clause I of the Purchase Terms, access as a Subscriber shall remain in force indefinitely to the extent that the automatic renewal box for the subscribed subscription is active or, if the Subscriber has ticked the box to cancel the automatic renewal of the subscribed subscription in accordance with the Purchase Terms, Subscriber access shall remain valid for a period of one (1) year from the validity of the subscribed subscription, that is, from the effective registration on the Website.

2.3 Account deletion and erasure of personal data.

The User may request the deletion of their account at any time from the Website or the mobile application. Such deletion shall result in the loss of access to all contracted services, tickets, subscriptions or associated benefits, without such deletion giving rise to refunds of amounts paid, unless the applicable regulations so require.

In accordance with the applicable data protection regulations, Abonoteatro shall delete, together with the user's account, the personal data that are no longer necessary for the provision of the service, retaining only those whose conservation is necessary for compliance with Abonoteatro's legal obligations or for the filing, exercise or defence of claims. Such data shall be duly blocked during the applicable legal periods.

III. FEATURES OF THE PRIVATE AREA

Once access to the private area has been obtained, the Subscriber may view and access the full content of the theatre, cinema and any other event programming offered by ABONOTEATRO, which allows each of the theatre, cinema and any other plans and events available on the Website to be viewed, including premium shows, whose tickets shall be subject to special conditions indicated in Clause I of the Purchase Terms.

If the Subscriber wishes to purchase an additional ticket (for a companion) for any premium shows, the price of such additional companion ticket shall be reduced compared with users who do not have subscriber status.

IV. INTELLECTUAL AND INDUSTRIAL PROPERTY

The Subscriber acknowledges and accepts that ABONOTEATRO is the exclusive owner and holder, or, where applicable, has the corresponding licences, of the intellectual property, industrial property and any other rights relating to the Website. This includes, among others and without limitation, the rights of fixation, reproduction, distribution, public communication, making available and transformation over the Website and any of its elements, including source code, object code, technical documentation, user manuals, texts, photographs or illustrations, logos, trademarks, graphics, interfaces, designs, etc., as well as any other element related to or derived from them.

Acceptance of these Terms of Use shall not be understood as assigning to the Subscriber any intellectual property, industrial property or any other right relating to the Website, beyond the right to use it under the terms established herein. Accordingly, by accessing the Website, the Subscriber acquires a mere right to use the content, services and/or functionalities of the Website during its use, and solely for the purpose of enjoying the service features in accordance with these Terms of Use.

The Subscriber may not use registered trademarks or trade names, or other distinctive signs, such as the ABONOTEATRO® trademark, whether owned by ABONOTEATRO or by third-party companies, without the consent of ABONOTEATRO or of their legitimate owners. At no time, unless expressly stated otherwise, shall access to or use of the Website or its contents grant any right over the distinctive signs included therein.

ABONOTEATRO reserves all intellectual and industrial property rights over the contents of the Website and the Website itself.

In accordance with the foregoing, the Subscriber undertakes not to:

Duplicate, reproduce, copy, sell, rent, lease, license, distribute or otherwise use the Website software for a use other than that expressly authorised in these Terms of Use;
Decompile, modify, reformat, translate, carry out reverse engineering, disassemble or otherwise access the source code of the Website software, without prejudice to the fact that applicable legislation may expressly allow such activities regardless of the existence of an agreement or authorisation to the contrary with the Subscriber;
Divide or fragment the Website and any of its content into different parts or modules in order to use them independently;
Reproduce or copy, distribute, allow public access through any form of public communication, transform or modify the contents of the Website, unless authorised by the holder of the corresponding rights.
Alter or remove any notices relating to intellectual property, industrial property or any other rights included on the Website, as well as any technical protection devices or information mechanisms that may be inserted in the content provided on the Website;
Infringe the intellectual property, industrial property or any other rights that ABONOTEATRO holds over the Website;
Develop and/or exploit in any way computer programs, applications or IT products of any other kind that perform a function similar to that of the Subscriber Members area, provided that such development is based on intellectual property assets owned by ABONOTEATRO or on knowledge acquired as a result of the contractual relationship existing with the Subscriber in their capacity as subscriber to the Website;
Modify, copy, reproduce, publicly communicate, transform, extract or distribute, by any means and in any form, all or part of the content and information included on the Website for public, commercial or non-commercial purposes, without the prior, express and written authorisation of ABONOTEATRO in each case or, where applicable, of the holder of the corresponding rights;
Register trademarks, trade names or any other distinctive sign associated with or that could be associated with the Website.

In order to allow ABONOTEATRO to effectively monitor and defend its intellectual property rights, ABONOTEATRO may collect information, as well as any other data that may be relevant for the purpose of verifying the effective use of the Website.

In this regard, the Subscriber expressly authorises ABONOTEATRO to use the information collected during the use of the Website as effective evidence of such use in any type of cause and proceeding of any nature, whether against the Subscriber themselves or against any third party.

Likewise, if any Subscriber or third party considers that any of the contents of the Website infringes their intellectual and/or industrial property rights, as well as any other rights, they must send a communication to atencionalabonado@abonoteatro.com with the following information:

Identification details and contact method of the claimant or their legal representative.
Documentation evidencing their status as holder of the allegedly infringed rights.
Detailed account of the rights allegedly infringed by ABONOTEATRO, as well as their exact location within the Website.
Express statement by the claimant that the content has been used without the consent of the holder of the allegedly infringed rights.

V. LINKS

5.1. Links to other websites

If links to other websites are displayed on the Website through different buttons, links, banners or embedded content, ABONOTEATRO informs Subscribers that these are managed by third parties, and therefore ABONOTEATRO has neither the human nor technical means to know in advance and/or control and/or approve all information, content, products or services provided by other platforms to which links may be established from the Website.

Consequently, ABONOTEATRO cannot assume any type of responsibility for any aspect relating to the website to which a link may be established from the Website, specifically, by way of example and without limitation, regarding its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents in general.

In this regard, if Subscribers become aware that the activities carried out through these third-party websites are illegal or contravene morals and/or public order, they must immediately inform ABONOTEATRO so that the access link to them may be disabled, an action that shall be carried out as soon as possible.

In any case, the establishment of any type of link from the Website to another third-party website shall not imply the existence of any type of relationship, collaboration or dependence between ABONOTEATRO and the owner of such third-party website.

5.2. Links on other websites, platforms and/or social networks to the Website

ABONOTEATRO does not authorise the establishment of a link to the Website from websites, platforms and/or social networks that contain unlawful, illegal, degrading or obscene materials, information or content, and, in general, that contravene the law, morals or public order, or generally accepted social norms.

In any case, links directing to the Website may be established, provided that the corresponding websites, platforms and/or social networks comply with each and every one of the following conditions:

The link may not reproduce the content of the Website or parts thereof in any way;
it is not permitted to create a browser or a border environment over the sections and services offered through the Website, nor may the Website be modified in any other way;
it is not permitted to make false, inaccurate or incorrect statements or indications about the Website and/or, in particular, to state or imply that ABONOTEATRO has authorised the link or has supervised or assumed in any way the contents or services offered or made available on the website, platform or social network on which such link is established;
the website, platform and/or social network on which the link to the Website is established shall not contain unlawful information or content, content contrary to generally accepted morals and good customs and public order, nor shall it contain content contrary to any third-party rights, including intellectual and industrial property rights and/or the right to honour, personal or family privacy or one's own image or any other right, or content contrary to the rules governing the protection of personal data.

ABONOTEATRO has neither the authority nor the human or technical means to know, control or approve all information, content, products or services provided by other websites, platforms and/or social networks that have established links to the Website. ABONOTEATRO assumes no responsibility of any kind for any aspect relating to the website, platform and/or social network that establishes such link to the Website, specifically, by way of example and without limitation, regarding its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents in general.

VI. LIMITATION OF LIABILITY

ABONOTEATRO does not guarantee continued access, nor the correct display, download or usefulness of the elements and information contained on pages linked to the Website, which may be prevented, hindered or interrupted by factors or circumstances beyond its control. Likewise, ABONOTEATRO is not responsible for decisions that may be adopted as a result of access to the content or information offered through such linked sites.

ABONOTEATRO may interrupt the service or immediately terminate the relationship with the Subscriber if it detects that use of the Website or any of the services offered under it is contrary to these Terms of Use. ABONOTEATRO is not responsible for damage, loss, claims or expenses arising from the use of the Website. It shall only be responsible for removing, as soon as possible, content that may generate such damage, provided that it is notified accordingly.

In particular, it shall not be responsible for damage that may arise, among others, from:

Interference, interruptions, failures, omissions, telephone faults, delays, blockages or disconnections, interruptions of availability or errors in the operation of the electronic system and/or the Website, caused by deficiencies, overloads, failures and/or errors in telecommunications lines and networks, or by any other cause beyond ABONOTEATRO's control;
Unlawful intrusions through the use of malicious programs of any kind and through any means of communication, such as computer viruses or any others;
Improper or inappropriate abuse of the Website;
Security or browsing errors caused by malfunction of the browser or by the use of outdated versions thereof.

VII. SUSPENSION, INTERRUPTION OF SERVICE AND TERMINATION

Breach by the Subscriber of any of the obligations provided in these Terms may entail the adoption by ABONOTEATRO of the appropriate measures protected by law and in the exercise of its rights or obligations, which may include the deletion or blocking of the offending Subscriber's account and, therefore, the withdrawal of the subscription purchased by the Subscriber, without any possibility of compensation for damages caused.

In particular, ABONOTEATRO reserves the right to suspend the service offered through the Website, without prior notice, or even to terminate these Terms, if it has a well-founded suspicion with respect to any Subscriber due to fraud in the use of the subscription, ticket resale, obstructive conduct by the Subscriber and/or improper use of the intellectual or industrial property rights of the Website, including its contents, without giving the alleged infringer any right to receive compensation.

Likewise, ABONOTEATRO expressly reserves the possible exercise of any legal actions that may be appropriate against the Subscriber or third parties for fraudulent use or use that in any way contravenes these Terms.

VIII. INDEMNITY OF ABONOTEATRO

The Subscriber shall defend, indemnify and hold ABONOTEATRO harmless from any damage or loss arising from claims, actions or demands by third parties as a consequence of their use of the Website. Likewise, the Subscriber undertakes to indemnify ABONOTEATRO against any damage or loss arising from their use of “robots”, “bots”, “spiders”, “crawlers” or similar tools used for the purpose of collecting or extracting data, or any other action by them that imposes an unreasonable burden on the operation of the Website.

Access to the services, events or any other content provided through the Website shall be carried out under the sole responsibility of the Subscribers. If minors or incapacitated persons are involved, responsibility shall lie with their parents, representatives or legal guardians, who must accompany, supervise or take appropriate precautions during their browsing of the Website.

If the Subscriber negligently or wilfully breaches any of the obligations established in the Terms of Use, they shall be liable for all damage and loss that may arise for ABONOTEATRO from such breach.

IX. PRIVACY AND DATA PROTECTION

In accordance with Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation) and Organic Law 3/2018 of 5 December on Personal Data Protection and guarantee of digital rights, all personal data collected during use of the Website shall be processed in accordance with the Privacy Policy, which every Subscriber must expressly accept if they provide personal data through the private area.

X. CUSTOMER SERVICE AND SUBSCRIBER CARE

ABONOTEATRO, as the party responsible for the Website, makes the following email address available to Subscribers atencionalabonado@abonoteatro.com for the purpose of providing online support and assistance, as well as to receive any comments, queries, suggestions or concerns from the Subscriber, both during the procedures for contracting the services and subsequently, in relation to the services offered through the Website, the Terms and/or the Privacy Policy, and, where applicable, in order to inform ABONOTEATRO of the existence of any content considered contrary to the law, these Terms of Use and/or infringing the legitimate rights of third parties, so that ABONOTEATRO may review such content and, where applicable, remove or disable it as soon as possible.

Furthermore, it should be recalled that the Subscriber has ABONOTEATRO's contact details set out in Clause I of these Terms of Use.

The Subscriber may also contact the Subscriber Care and Support Service through the following telephone number enabled for this purpose: 911 33 13 50. This service shall be available from Monday to Friday (excluding public holidays), during the time slots updated in the “DO YOU NEED HELP?” section of the Website.

The Subscriber care service shall respond to claims or queries received as soon as possible, which in no case shall exceed forty-eight (48) hours from the date on which the claim or query was submitted.

XI. GENERAL PROVISIONS

The headings of the various clauses are for information purposes only and shall not affect, qualify or broaden the interpretation of these Terms of Use.

The temporal validity of these Terms of Use coincides with the time they are displayed, until they are totally or partially modified, at which point the new modified Terms shall become valid.

ABONOTEATRO may terminate, suspend or interrupt, at any time and without prior notice, access to the contents of the Website, without the Subscriber being able to claim any compensation. After such termination, the prohibitions on use of the contents set out above in these Terms of Use shall remain in force.

If any provision of these Terms of Use is declared null and void or unenforceable, in whole or in part, by any competent Court, Tribunal or administrative body, such nullity shall not affect the remaining provisions of the Terms of Use.

The failure by ABONOTEATRO to exercise or enforce any right or provision contained in these Terms of Use shall not constitute a waiver thereof, unless acknowledged and agreed in writing by ABONOTEATRO.

These Terms of Use shall be kept in electronic format by ABONOTEATRO and shall remain permanently available to the Subscriber.

The Subscriber and ABONOTEATRO shall formalise the contract in the Spanish language, which shall be the language of interpretation of these Terms of Use.

If, after completing all the necessary procedures to browse and access the Website and perfect these Terms of Use, the Subscriber identifies any error when entering their data, they must immediately contact ABONOTEATRO through the contact form or the email address enabled for this purpose and identified in Clause I of these Terms of Use. ABONOTEATRO shall provide the necessary support and, where applicable, correct the identified errors.

Unless otherwise indicated in these Terms of Use, notifications between the Subscriber and ABONOTEATRO must be made in writing by email or by sending a certified letter to the corresponding addresses. For these purposes, ABONOTEATRO's contact details shall be those appearing in these Terms of Use and the Subscriber's contact details shall be those provided in the registration form on the Website.

SECOND SECTION. PURCHASE TERMS

These purchase terms (hereinafter, the “Purchase Terms”) regulate the purchase of the Subscription offered on the Website by any Subscriber.

Before purchasing the Subscription offered on the Website, the Subscriber is obliged to read and accept these Purchase Terms. By such acceptance, the Subscriber expressly agrees to be bound by them in their entirety and scope, without excluding any of their provisions.

ABONOTEATRO reserves the unilateral right to modify these Purchase Terms. Therefore, it is the Subscriber's responsibility to periodically read the current conditions applicable to them.

It is mandatory that any Subscriber who uses, accesses, browses or purchases the products offered on the Website be of legal age or, failing that, have the corresponding authorisation from their legal guardians.

I. PURCHASE OF THE SUBSCRIPTION OFFERED BY ABONOTEATRO. SUBSCRIPTION PRICE

In order to view and access the full content of the theatre, cinema and any other event programming offered by ABONOTEATRO, the Subscriber must acquire such status by purchasing the Subscription offered by ABONOTEATRO and registering on the Website in accordance with the Terms of Use. This consequently allows viewing each of the theatre, cinema and any other plans and events available on the Website, including premium shows (whose tickets shall be subject to special conditions indicated in these Purchase Terms), and purchasing tickets for such plans and events. The Subscriber shall also have the possibility of purchasing an additional ticket for a companion, which may be purchased by the Subscriber, if they so wish, by paying the corresponding price established on the Website, which shall be reduced compared with users who do not have Subscriber status.

In order to purchase a Subscription, the Subscriber must comply with these Purchase Terms. The Subscription is configured as a FLAT RATE under which, with one (1) single annual payment of fifty-nine euros and ninety cents (EUR 59.90) + three euros and fifty cents (EUR 3.50) as an additional price for management fees (hereinafter, the “Subscription Price”), Subscribers may enjoy more than seventy (70) shows in different venues (Monday to Sunday), access to more than twenty (20) cinema venues in the Community of Madrid (Monday to Thursday, excluding public holidays) and, in addition, concerts, events and other special actions offered at any given time on the Website. In this way, Subscribers shall only have to pay the total amount of three euros and fifty cents (EUR 3.50) for each ticket they purchase for themselves.

Without prejudice to the foregoing, the rate equivalent to the Subscription Price and/or the Final Price (as defined below) may be modified by ABONOTEATRO, such that ABONOTEATRO shall charge the Client for the provision of the service the rates in force at any given time in its commercial offer, to which the Subscriber adheres when contracting and purchasing the Subscription and which shall be available to the Subscriber on the following website www.abonoteatro.com.

The purchased Subscription shall be valid for one (1) year from the date of its effective registration on the Website by the corresponding Subscriber. ABONOTEATRO informs that the Subscription consists of an annual subscription that shall be automatically renewed upon the expiry date of the Subscription, charged to the credit card saved by the Subscriber in their profile in the private area. The Subscriber hereby expressly authorises ABONOTEATRO to carry out such automatic renewal. To cancel this automatic renewal, the Subscriber may enter MY ACCOUNT – MY ABONOTEATRO and click on “If this box is selected, your Subscription WILL NOT BE AUTOMATICALLY RENEWED.”.

Any modification to the Subscription Price and/or Final Price rates shall be communicated to the Subscriber at least one (1) month before the effective date of such modification.

The modification of the Subscription Price and/or Final Price rates shall entitle the Subscriber to terminate these Purchase Terms in the event of disagreement with the new rates (by way of example only, at the time of renewal of the subscription subscribed by the Subscriber), by notifying ABONOTEATRO of this circumstance within a maximum period of fifteen (15) calendar days following receipt of the corresponding communication from ABONOTEATRO.

In any case, variations that may occur in taxes legally passed on to the Subscriber, which shall enter into force on the date legally established, shall not be considered modifications of rates for the purposes set out herein.

Once the necessary data classified as mandatory have been correctly provided, by pressing the “Register” button on the form, the Subscriber may create and access a private area. In accordance with the Terms of Use, once inside the private area, the Subscriber may access the information to purchase, if they so wish, tickets for the different plans offered by ABONOTEATRO through the Website.

In order to purchase the different events offered through the Website, the Subscriber must choose the plan for which they wish to purchase tickets in order to view the purchase price, which shall amount to the total sum of three euros and fifty cents (EUR 3.50) in management fees for each ticket obtained for themselves, and they may also bring one (1) companion for a reduced price of approximately five euros (EUR 5.00) or, where applicable, the reduced price indicated by ABONOTEATRO at the time of purchase through the Website + three euros and fifty cents (EUR 3.50) as an additional price for management fees (hereinafter, the “Final Price”).

Once the Final Price has been displayed, if the Subscriber wishes to proceed with the purchase of the corresponding tickets, they must pay the Final Price by bank debit using a credit or debit card from a bank account. In this regard, ABONOTEATRO uses the REDSYS payment service provider, whose service terms and conditions and privacy policy can be found on the website https://pagosonline.redsys.es/pago-online.html.

The Subscriber may only obtain one (1) ticket per day for any of the events available on the Website that coincide on the same day, although they may purchase several tickets per day provided that the events take place on different dates. As indicated above, each Subscriber shall also be entitled to purchase one (1) ticket for one (1) companion at a reduced price, plus three euros and fifty cents (EUR 3.50) in management fees.

The subscription and tickets purchased by each Subscriber are for INDIVIDUAL, PERSONAL and NON-TRANSFERABLE use.

Subscribers may not purchase tickets for events scheduled after the expiry date of the Subscription.

With regard to PREMIUM SHOWS, the Subscriber acknowledges and accepts that they may only purchase one (1) ticket for shows classified as PREMIUM during the year of validity of their subscription, since, because it is a one-off offer and a great opportunity, ABONOTEATRO seeks to ensure that the largest possible number of Subscribers can attend that premium show. For clarification purposes, if the Subscriber renews their subscription, they may again purchase a ticket for the same premium show if it appears again in the programme available on the Website.

Subscribers acknowledge and accept that they will always be required to present the Home ticket previously purchased through the Website for the corresponding event, together with their National ID Card and/or ABONOTEATRO subscriber card at the box office or at the entrance to the venue. Refusal to show any of these documents and/or not being the Subscriber who is the holder of the ticket with which they intend to enter the corresponding venue shall be immediate cause for withdrawal of the subscription.

The Subscriber's data shall remain stored by ABONOTEATRO until the purchase has been made, and for the time necessary for ABONOTEATRO to diligently comply with its obligations. The data entered by the Subscriber must be true, and ABONOTEATRO shall be free from liability in cases where the Subscriber, whether voluntarily or involuntarily, enters data that do not correspond to reality.

Once payment has been made, the Subscriber shall receive the invoice in electronic format at the email address provided in the corresponding form.

II. FINAL PRICE

The Subscriber shall know the Final Price of the tickets purchased before paying the corresponding price. The Final Price shall include VAT in all cases and shall be expressed in Euros.

The purchased tickets shall be invoiced at the Final Price in force at the time of the order, except for promotions and/or campaigns. ABONOTEATRO reserves the right to apply discounts to the Final Price.

In any case, the Final Price shall be shown to the Subscriber at the time the effective purchase is to be made (payment time) in accordance with these Purchase Terms.

III. VIEWING OF CONTENT

Once the Subscription Price has been paid, and the Subscriber registration process on the Website has been completed in accordance with the Terms of Use, the Subscriber may view the full content of the programming of plans and events offered by ABONOTEATRO through the Website, as well as the plans purchased in their private area of the Website once the corresponding Final Price has been paid. In order to correctly view the full content referred to above, the Subscriber must have an Internet connection.

IV. RIGHT OF WITHDRAWAL

When purchasing the Subscription offered by ABONOTEATRO, the Subscriber shall have a maximum withdrawal period of fourteen (14) days from the date of purchase of such Subscription, provided that such Subscription has not been used during this withdrawal period. In this regard, the Subscriber shall not have the right to withdraw from the contract formalised through these Purchase Terms in accordance with Article 103.m) of Royal Legislative Decree 1/2007 approving the General Law for the Defence of Consumers and Users, once the Subscriber has used the Subscription and has purchased any ticket for any plans offered on the Website.

V. MINIMUM DURATION OF THE SUBSCRIBER'S OBLIGATIONS

Once the Subscription has been purchased, tickets for any plans offered on the Website have been selected and the Final Price has been paid, the Subscriber may not suspend, cancel or modify the purchase thereof. In this regard, the Subscriber acknowledges and accepts that, when purchasing tickets on the Website, changes and refunds are not permitted.

VI. APPLICABLE LAW AND COMPETENT JURISDICTION

The sale of the Subscription and, where applicable, of tickets to any of the events offered on the Website is understood to be made in Spanish territory, and therefore Spanish common law shall apply to any interpretative or contentious issues that may arise and, in the event of a dispute, both parties agree to submit, waiving any other jurisdiction that may correspond to them, to the jurisdiction of the Courts and Tribunals of the consumer's domicile.

Likewise, pursuant to Regulation (EU) No. 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes, in the event of any dispute relating to the Contract, the Client may use the “Online Dispute Resolution Platform” developed by the European Commission through the following link: http://ec.europa.eu/consumers/odr/.
